These terms and conditions ("Terms") govern your use of Nostrascore application ("the Application"), provided by Dzmitry Matveyeu, an individual registered in Poland as a "Sole Proprietorship" with tax identification number PL8992909018 ("the Company," "we," or "us"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Application.
1.1 Eligibility: The Application is intended for use by individuals aged 18 years or older. By using the Application, you represent and warrant that you are at least 18 years old. If you are under 18 years old, you may use the Application only with the involvement and consent of a parent or legal guardian.
1.2 Non-Gambling: The Application is a game and does not involve gambling or wagering of any kind. Users will not be required to pay any money to make predictions, and no real money or virtual currency with monetary value will be used in the Application. Any attempt to charge or collect fees for participation will result in the immediate cancellation of the competition.
2.1 User-Generated Competitions: The Application allows users to create competitions and invite friends, colleagues, or other individuals to participate in football predictions. Users may create private competitions or join public competitions based on their preferences.
2.2 Predictions and Points: Users can make predictions for football matches within the competitions. The accuracy of predictions will be evaluated based on predefined criteria, and users will earn virtual points accordingly. The user with the highest number of virtual points at the end of the competition will be declared the winner.
2.3 Fair Play: Users are expected to make predictions in good faith and adhere to fair play principles. Any form of cheating, manipulation, or violation of the Application's rules may result in disqualification from the competition and potential termination of the user's account.
3.1 Payment processor: The Website utilizes a merchant of record model for payment processing. PayPro Global, Inc. ("Merchant of Record") will handle payment processing on behalf of Dzmitry Matveyeu ("Company").
3.2 Authorization: By making a purchase through the Website, you authorize the Merchant of Record to process your payment for the selected services.
3.3 Responsibility and Liability: While the Merchant of Record processes payments, Company remains responsible for the services provided to users. Any issues or disputes regarding purchases made through the Website should be directed to Company.
3.4 Refund Policy: Users who create competitions and make payments for services within the Application are eligible for a refund if the competition is canceled within a 14-day period after payment and is not in a Finished status. The refund will be issued automatically. In case of any issues, users should contact us at contact@nostrascore.com.
4.1 EligibilityOwnership: The Application, including all its content, features, and functionality, is owned by the Company and protected by intellectual property laws. You acknowledge that the Company retains all rights, title, and interest in and to the Application.
4.2 User Content: By using the Application, you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display any content you submit within the Application for the purpose of operating and improving the Application.
5.1 Data Collection: The Company respects your privacy and handles your personal data in accordance with applicable privacy laws. By using the Application, you agree to the collection, use, and disclosure of your personal information as outlined in the Company's Privacy Policy.
5.2 Account Security: You are responsible for maintaining the confidentiality of your account login information. You agree to notify the Company immediately of any unauthorized access or use of your account.
6.1 Disclaimer: The Application is provided on an "as is" and "as available" basis. The Company makes no warranties or representations, express or implied, regarding the Application's accuracy, reliability, or availability.
6.2 Indemnification: You agree to indemnify, defend, and hold the Company harmless from any claims, damages, liabilities, or expenses arising out of your use of the Application or any violation of these Terms.
7.1 Amendments: The Company reserves the right to modify these Terms at any time. Updated Terms will be posted within the Application, and your continued use of the Application after the posting of any changes constitutes your acceptance of the modified Terms.
7.2 Termination: The Company may suspend or terminate your access to the Application at any time, without prior notice or liability if you breach these Terms.
